Notwithstanding the penalty contained in Section 935.99, and in addition thereto, when the Arborist ascertains that trees and shrubbery are growing on land within the Municipality, in violation of Section 935.09(a), (b) or (c), then he shall cause written notice to be served upon the owner, lessee, agent or tenant having charge of any lot or land within the Municipality that such trees or shrubbery are growing in violation on such land, and that they must be trimmed or removed in five days after the service of the notice. If the owner or other person having charge of the land is a nonresident whose address of the owner is unknown, the notice shall be sent to his address by registered mail; if the address of the owner is unknown, it shall be sufficient to publish the notice once in a newspaper of general circulation in Cuyahoga County.
Any police officer may make service and return of the notice provided for in this section.
