(a) Whenever the City of Cleveland, Division of Water, issues any directive to the public to conserve water, or, at any time that the Brook Park Director of Public Safety determines that a significant water shortage exists in the City of Brook Park, a public water emergency is declared to exist.
(b) Whenever such an emergency exists, the Brook Park Director of Public Safety shall request the cooperation of the local press, radio and television stations to announce the emergency and the time that emergency use regulations will become effective. Such emergency use regulations shall become effective no sooner than one hour after the first announcement. Such announcement by two local radio stations, or two local television stations, or in a daily newspaper of general circulation in the City, shall constitute notice to the general public of the existence of the emergency. The emergency shall continue until announcement by the Brook Park Director of Public Safety or the City of Cleveland, Division of Water, that the emergency has ceased to exist. Such announcement that the emergency has ceased to exist shall be made in the same manner as outlined above: two local radio stations, or two local television stations, or in a daily newspaper of general circulation in the City.
(c) During the period of emergency, the Brook Park Director of Public Safety may prohibit the use of any water for the sprinkling or irrigation of lawns and/or gardens and for the washing of motor vehicles and the filling of swimming pools. The Brook Park Director of Public Safety may also prohibit any use of water for other than drinking and sanitation purposes. The prohibited uses shall be specified in the announcement of the public water emergency.
(d) Whoever violates such emergency use regulation shall be deemed guilty of misconduct at an emergency and shall be punished pursuant to Section 509.05(c) of the General Offenses Code.
