517.11 OTHER CHARITABLE GAMBLING ACTIVITIES; APPLICATION; FEES.
   (a)   As used in this section, "other charitable gambling activities" includes, but is not limited to, "Las Vegas" - type events. "Gaming operation" includes schemes of chance and games of chance.
   (b)   (1)   An application for a gaming operation must be completed on forms supplied by the Police Department at least two weeks prior to the date upon which the gaming activity is scheduled to take place.
      (2)   The request shall be made to the Chief of Police or his or her representative advising him or her that a gaming operation will be held in the City.
      (3)   If the application is not properly filled out and returned to the Police Department prior to the two-week notification period, the application will be denied.
      (4)   The application shall provide the following information:
         A.   The name of the rental or leasing company; and
         B.   The IRS 501(C)(3) or 501(C)(19) holder.
      (5)   Community-based organizations that are tax exempt may qualify for raffles upon approval of the Chief of Police or his or her designee.
   (c)   The rental or leasing company or 501(C)(3) or 501(C)(19) holder shall not be changed within seven days of the gaming operation.
   (d)   All operators shall have a valid permit, as well as all other State and Federally- mandated paperwork on the premises at all times during the running of the gaming operation.
   (e)   (1)   A fee of twenty-five dollars ($25.00) shall be paid to the City through the Chief of Police or his or her representative for every 501(C)(3) or 501(C)(19) holder for each address in which a gaming operation is held within the City.
      (2)   The fee shall be good for one calendar year, from January 1 to December 31. The holder must pay this fee each and every calendar year that the holder continues to conduct a gaming operation.
   (f)   A member or board member of a nonprofit organization must be present at all times during the hours of operation of the gaming operation. The board member present cannot be from the rental or leasing company. The board member shall show some type of credentials to document his or her association with the nonprofit organization, and names of the board member who may be present shall be supplied to the police prior to the gaming activity commencing. If such person is not present, all gaming operations shall immediately cease until such individual is present.
   (g)   A licensed, armed security officer or an off-duty City police officer must be present during the hours of operation of the gaming operation.
   (h)   All other Federal, State and local laws shall be complied with.
   (i)   Hours of operation shall be as follows:
      (1)   "Vegas Night" style. gaming operations may begin at 1500 hours on the first day and conclude no later than 0230 hours the next day; the activity may not resume until 1400 hours on day two and end at 0230 hours the next day; the activity may not resume until 1400 hours on day three and end at 0230 hours the next day; if there is a fourth day hours will resume at 1400 hours and conclude at 0230 hours the next day.
      (2)   Homedays. During festival hours only; no earlier than 1300 hours and no later than 0000 (Midnight).
      (3)   Raffles. 1700 hours to 0000 (Midnight); a change in raffle hours may be obtained with the prior approval by the Chief of Police.
   (j)   Whoever violates this section is guilty of a misdemeanor of the fourth degree.
