As used in this chapter:
(a) "Motorized scooter." Any two-wheeled device that has handlebars, is designed to be stood or sat upon by the operator, and is powered by an electric motor, or gasoline two-stroke engine and is capable of propelling the device with or without human propulsion. A "motorized scooter" is further described as: (1) Being designed to travel on not more than three wheels in contact with the ground; (2) having no pedals and not being capable of being pedaled; (3) having an engine or motor that is capable of propelling the vehicle at a speed not greater than 25 miles per hour on a level surface; (4) is designed or intended by its manufacturer to be utilized primarily as a recreational or pleasure vehicle or a vehicle for traveling short distances; and (5) is neither designed nor intended by its manufacturer to be utilized primarily as an assistive device to increase, maintain or improve the mobility of an individual with a disability or other physical condition that limits or impairs the individual's ability to walk.
(b) "Dealer." Any person or firm engaged in the business of manufacturing or selling motorized scooters at wholesale or retail, or who rents, leases or otherwise furnishes motorized scooters for hire.
(c) "Operator." Any person who operates or is in actual physical control of a motorized scooter, or other right to the possession thereof.
