313.11 MOBILE INFRARED TRANSMITTERS.
   (a)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      (1)   "Mobile infrared transmitter" means any device or mechanism that emits infrared signals with the purpose of changing a traffic signal.
      (2)   "Unauthorized user" means a user of a mobile infrared transmitter who is not authorized to use the transmitter for official government purposes.
   (b)   No individual or corporate or business entity shall buy, use or otherwise possess or sell a mobile infrared transmitter, except when one of the following applies:
      (1)   In the course of his or her employment by the State or a local authority;
      (2)   In the course of his or her employment by any manufacturer of mobile infrared transmitter devices;
      (3)   For the purpose of demonstrating the design and function of a mobile infrared transmitter to State or local officials; or
      (4)   When the mobile infrared transmitter has been purchased from the State or a local authority at a sale of property that is no longer needed or is unfit for use.
   (c)   Whoever violates this section is guilty of a misdemeanor of the third degree.
