153.11 INDEMNIFICATION OF CITY OFFICIALS.
   (a)   When an elected or appointed official, while in the good faith discharge of his duties imposed upon him by law or ordinance, is being sued while performing duties in such discharge, the Law Director shall defend the official or require the Mayor to contract for outside legal assistance to defend the accused official.
For purpose of this section, the phrase "elected or appointed public official" includes all members of boards and commissions whether appointed by the Mayor and/or Council or duly elected.
(Ord. 5024-1976. Passed 9-7-76.)
   (b)   In addition to providing for legal assistance, the sued official shall be indemnified for any judgment rendered against him in his personal capacity. However, this indemnification can only occur if the personal suit arose while the official was acting in the good faith discharge of his duties imposed upon him by law or ordinance.
   (c)   Nothing in this section shall be read or construed as being a waiver of the defense of governmental function of immunity, nor shall the section be read or construed so as to impute the liability of such official to the City.
(Ord. 5012-1976. Passed 8-17-76.)
