141.12 PAYMENT FOR POLICE CERTIFICATE OF PROFICIENCY, ASSOCIATE DEGREE OR JOB RELATED BACHELOR OR MASTER DEGREE IN POLICE TECHNOLOGY.
   (a)   The Police Chief or the Police Captain who has completed the course, and who has received a Police Certificate of Proficiency in Police Technology, shall receive two percent (2%) of his annual salary as an incentive for obtaining such certificate.
   (b)   The Police Chief or the Police Captain who has completed the course, and who has received an Associate Degree in Police Technology shall receive four percent (4%) of his annual salary as an incentive for obtaining such Certificate or Degree.
   (c)   The Police Chief or the Police Captain who has earned a degree above an Associate Degree in Police Technology, such as a Bachelor or Master Degree, and providing the courses taken to earn such Bachelor or Master Degree are job related to Police Technology, shall receive four percent (4%) of his annual salary as an incentive for obtaining such Degree.
   (d)   The payments referred to in subsections (a), (b) and (c) hereof are to be made at the time the required Certificate or Degree is received and also during the first pay period of July of each subsequent year; however, if an individual receives a two percent (2%) payment in July of any year for holding a Certificate of Proficiency and later in that same year obtains an Associate Degree or a job related Bachelor or Master Degree in Police Technology, the City shall pay that individual an additional two percent (2%) payment upon receipt of such Associate Degree or job related Bachelor or Master Degree in Police Technology.
   (e)   The maximum payment per year pursuant to this section shall be four percent (4%) of the individual's annual salary.
   (f)   The Police Chief of Police Captain who desires to attend class for the achievement of the above certification shall attend classes on his own time and/or compensatory time previously earned, and shall not be awarded overtime for classes attended while on his own time.
      (1)   If the Police Chief or Police Captain wishes to attend classes when scheduled for duty, using compensatory time, it shall first be determined by the Director of Public Safety that sufficient manpower is available, but if the Police Chief or Police Captain has no accumulated compensatory time and still desires to attend class during his scheduled working hours, he shall agree to reimburse the City for the time he has missed while attending class either by reimbursing the City in money or by working the equivalent number of hours he missed.
      (2)   The agreement to reimburse the City shall be in the form of a notarized affidavit signed by the Police Chief or Police Captain, as the case may be. The individual shall be obligated to reimburse the full amount due to the City upon completion and certification of the course. Such reimbursement shall be made in full not later than ten months from the date he individual first missed work to attend classes, or prior to his termination of employment with the City whichever is earlier in time.
   (g)   No payment shall be made until certificates are submitted to the Auditor, through the Director, who shall determine whether the Certificates or Degrees are valid.
   (h)   All elected subjects for credits toward the Associate Degree or job related Bachelor or Master Degree in Police Technology, shall be approved by the Director before enrollment in class.
