(A)   Except as otherwise provided in this chapter, no person shall engage in any land-disturbing activity within the town until he or she has acquired a land- disturbing permit.
   (B)   Issuance of a land-disturbing permit is conditioned on an approved erosion and sediment control plan which, or certification thereof, shall be presented at the time of application for the permit and, in addition, the requirements of § 151.20 concerning a performance bond, cash escrow, letter of credit, any combination of these requirements, or such other legal arrangement as is acceptable under the provisions of § 151.20 and to the fees levied in § 151.35 for land- disturbing activities.
