(A) (1) Effective as of November 1, 2022, the following monthly fees per dwelling for the collection, transportation, and disposal of solid waste, through its contract, are approved and adopted:

(2) Beginning on and after November 2, 2022, the fees, as approved and adopted herein, shall be owed, each month, by the occupant of each dwelling. If a dwelling is unoccupied, or upon the request of the owner or an occupied dwelling, the monthly fee shall be billed to the owner of the dwelling. The Town Council is basing the fees on 600 dwellings being served each month under and pursuant to the contract.
(3) If an owner or occupant of dwelling does not pay a fee within 30 days after it is due, the amount of the fee, together with a penalty of 10% and a reasonable attorney’s fee, may be recovered by the town in a civil action in the name of the unit.
(B) The town is authorized to provide for billing and collection for the trash collection services provided pursuant to a contract to begin 1 month prior to the beginning of the service.
(C) This user fee will be used to pay the costs of the services provided pursuant to the contract entered into by the town pursuant to § 53.16, and shall reimburse the town for additional overhead, including the cost of additional wages and benefits, office furnishings and supplies, accounting and other professional fees, and any other expenses which are reasonably related to the administration or enforcement of the contract let upon the authority of this subchapter.
(D) At such times as it deems appropriate, the town shall review the user fee and recommend changes as may be necessary to the Town Council, which may amend the user fee after giving public notice.
