§ 53.16 DEVELOPMENT OF TRASH COLLECTION PROGRAM.
   The town will proceed with development and implementation of a trash collection program, and the Town Council will be authorized to do all acts and execute all documents necessary to accomplish the aims of this subchapter, including but not limited to the following:
   (A)   Solicit bids and let 1 or more contracts to provide trash collection to residential users within the town;
   (B)   Determine the qualifications to be required of potential bidders which the Town Council deems desirable, giving proper regard to experience and financial responsibility while not unduly limiting the ability of potential bidders to present creative and flexible solutions to the problems presented by the specifications;
   (C)   Develop bid specifications which require, at a minimum, the following:
      (1)   That the successful bidder pick up trash at least weekly from residential users within the town;
      (2)   That the successful bidder have the ability to provide heavy trash pickup to be scheduled by provider;
      (3)   That, as a condition of bidding for this contract, the bidder agrees to refund that portion of a trash pickup fee which was prepaid by any residential user and which applies to the period after this contract commences; and
      (4)   That town buildings and the Town Park be provided with adequate trash collection.
   (D)   Make and enforce such bylaws and regulations as may be deemed necessary for the safe, economic and efficient management of the town’s trash collection program, and for the regulation, collection, rebating and refunding of any fees and charges as may be required to implement the programs.
