ADOPTING ORDINANCE
ORDINANCE 2005-14
AN ORDINANCE ADOPTING A CODE OF ORDINANCES
WHEREAS, I.C. 36-1-5-3 REQUIRES THE ORDINANCES OF A TOWN TO BE CODIFIED; AND
WHEREAS, THE TOWN OF BROOKLYN HAS CONTRACTED WITH THE AMERICAN LEGAL PUBLISHING CORPORATION TO CODIFY THE ORDINANCES OF THE TOWN AND THE FINAL DRAFT OF THE CODIFICATION HAS BEEN FILED WITH THE CLERK-TREASURER; AND
WHEREAS, THE CODE OF ORDINANCES OF THE TOWN OF BROOKLYN, AS FILED, IS A CODIFICATION OF PREVIOUSLY EXISTING LAWS; AMENDMENTS THERETO INCLUDING, MORE SPECIFICALLY, CHANGES AND ADDITIONS TO PENALTY PROVISIONS FOR VIOLATING TOWN ORDINANCES; AND NEWLY ENACTED ORDINANCES.
NOW BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF BROOKLYN, MORGAN COUNTY, INDIANA:
SECTION 1. THAT THE CODE OF ORDINANCES OF THE TOWN OF BROOKLYN AS PREPARED AND FILED BY THE AMERICAN LEGAL PUBLICATION CORPORATION IS NOW ADOPTED AS THE CODE OF ORDINANCES OF THE TOWN OF BROOKLYN;
SECTION 2. THAT THE LENGTH OF TIME NECESSARY TO CODIFY AND ADOPT A CODE OF ORDINANCES COULD NOT HAVE REASONABLY BEEN FORESEEN AND THE INABILITY TO ENFORCE TOWN ORDINANCES REQUIRES IMMEDIATE ACTION AND THREATENS THE PUBLIC HEALTH, WELFARE OR SAFETY OF THE TOWN. THEREFORE, THE BROOKLYN TOWN COUNCIL DECLARES AN EMERGENCY UNDER I.C. 36-1-2-4.5;
SECTION 3. THAT THIS ORDINANCE SHALL BE PUBLISHED PURSUANT TO I.C. 5-3-1 (ONE TIME) AND A COPY OF THIS ORDINANCE, TOGETHER WITH A COPY OF THE CODE OF ORDINANCES OF THE TOWN OF BROOKLYN, SHALL BE MADE AVAILABLE FOR INSPECTION DURING NORMAL BUSINESS HOURS FOR THE NEXT 30 DAYS AT THE BROOKLYN LIBRARY, THE BROOKLYN DAIRYLAND, AND THE BROOKLYN TOWN HALL;
SECTION 4. THAT COPIES OF THE CODE OF ORDINANCES OF THE TOWN OF BROOKLYN MAY BE PURCHASED FOR $25 AT THE BROOKLYN CLERK-TREASURER'S OFFICE;
SECTION 5. THAT THIS ORDINANCE SHALL BE IN EFFECT UPON PASSAGE AND THE SIGNATURE OF THE TOWN COUNCIL PRESIDENT; AND
SECTION 6. THAT ALL ORDINANCES, RESOLUTIONS OR MOTIONS IN CONFLICT WITH THIS ORDINANCE ARE HEREBY REPEALED OR RESCINDED.
