337.99 PENALTY.
   (EDITOR'S NOTE: See Section 303.99 for penalties applicable to any misdemeanor classification.)
   (a)   General Chapter Penalty. Whoever violates any provision of this chapter, for which violation no penalty is otherwise provided, is guilty of a misdemeanor of the fourth degree on a first offense; on a second offense within one year after the first offense, such person is guilty of a misdemeanor of the third degree; on each subsequent offense within one year after the first offense such person is guilty of a misdemeanor of the second degree.

   (b)   Special Engine Brakes. Whoever violates Section 337.201 is guilty of a misdemeanor of the fourth degree.

   (c)   Child Restraint Systems.
      (1)   Whoever is a resident of this State and violates Section 337.26 is guilty of a minor misdemeanor on a first offense; on a second or subsequent offense, that person is guilty of a misdemeanor of the fourth degree.
      (2)   Whoever is not a resident of this State, violates Section 337.26, and fails to prove by a preponderance of the evidence that the offender’s use or nonuse of a child restraint system was in accordance with the law of the state of which the offender is a resident is guilty of a minor misdemeanor on a first offense; on a second or subsequent offense, that person is guilty of a misdemeanor of the fourth degree.

   (d)   Seat Belt Requirements.
      (1)   Whoever violates Section 337.27(b)(1) shall be fined thirty dollars ($30.00).
      (2)   Whoever violates Section 337.27(b)(3) shall be fined twenty dollars ($20.00).
