(a) Council may establish and amend from time to time such full-time and part-time and seasonal positions both within and outside the classified civil service as are necessary to implement the recreation program and Service Departments.
(b) All part-time, hourly-rated, and seasonal positions within the recreation program and Service Department are designated unclassified civil service positions.
(c) There shall be two methods for original appointment of police officers to the Police Department and firefighters to the Fire Department: civil service examination with placement on the certified eligible list, and non-competitive lateral hire. Lateral-hire candidates must conform to certain minimum qualifications which shall be established and maintained within the City of Brooklyn Civil Service Commission's rules and regulations, including fitness or agility, prerequisite qualifications governing certification, previous employment, maximum duration of any breaks in service, prior employment based upon a civil service examination process, and background investigations and evaluations. The Civil Service Commission's rules and regulations shall provide for the grades into which lateral transfers shall be hired, the seniority obtained by lateral hires, the order of hire as it relates to candidates on certified eligible lists, the layoff order, and the probationary period to be completed by lateral hires.
(d) Whenever he or she deems it to be in the best interest of the City, the Mayor shall have full authority to leave positions in the classified or unclassified civil service vacant or to combine the duties of two positions under a single employee, unless such decision is superseded by any provisions of a collective bargaining agreement.
(e) The Civil Service Commission is authorized to promulgate rules and procedures for the administration of the testing and selection methodology not inconsistent with this section. This section is specifically intended to supersede state code with respect to appointments to and the filling of vacancies in positions in the classified and unclassified civil service, pursuant to the City's home rule authority.
