149.09 OVERTIME COMPENSATION.
   (a)   Overtime Policy for Directors and Other Officials.  
      (1)    The Mayor, Director of Public Service, Director of Finance, Director of Economic Development, Building Commissioner, Police Chief and Fire Chief are exempt employees under the Fair Labor Standards Act and shall not receive overtime pay or compensatory time.
      (2)    The Law Director, Prosecutor, Magistrate, Recreation Commissioner and Safety Director are salaried employees and are not due or to be paid overtime or compensatory time under the Fair Labor Standards Act.
      (3)   The following additional officials are exempt employees under the Fair Labor Standards Act and shall not receive overtime pay or compensatory time: members of Brooklyn City Council, Prosecutor, Administrative Assistant to the Mayor, Magistrate, and Recreation Commissioner.
   (b)    Overtime Compensation for the Secretary to the Mayor. The Secretary to the Mayor shall receive overtime for work performed in excess of eight (8) hours per day, and/or forty (40) hours per week, with the advance approval of the Mayor. The employee shall be compensated, at the employee's election (the employee must advise the employer of his or her election quarterly prior to April 1, July 1, October 1 and January 1), either at the rate of one and one-half (1-1/2) times the employee's regular hourly rate for all overtime, or compensatory time off computed at the same rate, to be taken within six (6) months as approved by the Mayor. Overtime must be requested, submitted and paid in a timely manner.
   (c)    Overtime Compensation for the Coordinator of Senior Services. The Coordinator of Senior Services shall receive overtime for work performed in excess of eight (8) hours per day, and/or forty (40) hours per week, with the advance approval of the Mayor and/or director. The employee shall be compensated, at the employee's election, (the employee must advise the employer of his/her election quarterly prior to April 1, July 1, October 1 and January 1) either at the rate of one and one-half (1-1/2) times the employee's regular hourly rate for all overtime, or compensatory time off computed at the same rate, to be taken within six (6) months as approved by the department head. Overtime must be requested, submitted and paid in a timely manner.
 
   (d)   Overtime Compensation for the General Foreman. The General Foreman shall receive overtime for work performed in excess of eight (8) hours per day and/or 40 hours per week, with the advance approval of the Mayor and/or director. The employee shall be compensated, at the employee's election, (the employee must advise the employer of his/her election quarterly prior to April 1, July 1, October 1 and January 1) either at the rate of one and one-half (1-1/2) times the employee's regular hourly rate for all overtime, or compensatory time off computed at the same rate, to be taken within six months as approved by the department head. Overtime must be requested, submitted and paid in a timely manner.
 
   (e)   Overtime Compensation for the Recreation Manager. The Recreation Manager shall receive overtime for work performed in excess of eight (8) hours per day and/or forty (40) hours per week, with the advance approval of the Mayor and/or director. The employee shall be compensated, at the employee's election, (the employee must advise the employer of his/her election quarterly prior to April 1, July 1, October 1 and January 1) either at the rate of one and one-half (1-1/2) times the employee's regular hourly rate for all overtime, or compensatory time off computed at the same rate, to be taken within six (6) months as approved by the department head. Overtime must be requested, submitted and paid in a timely manner.
   (f)    Whenever approved by the Mayor and/or director, a non-exempt employee called in to work or appearing in court on behalf of the employer when the employee is not on duty shall be compensated not less than two (2) hours at the one and one-half (1-1/2) rate subject to the election method in which compensation is to be received as set forth within subsections (b) through (e) hereof.
