(a) For the purposes of this chapter, "public social function" shall mean an event on public or private property at which an admission fee is charged, directly or indirectly, or in which any consideration of any kind whatsoever is a prerequisite to gaining entrance, or at which a charge is made for the use or rental of a public or private hall, the expected or reasonably likely attendance for which event will exceed one hundred persons if alcohol is being served or otherwise two hundred persons. This definition shall not include any city-sponsored public social functions or those held in restaurants as defined in Section 1109.01.
(b) For the purposes of this chapter, "special event" shall mean an activity in a public park, on public grounds or within the public right-of-way at which either a group of ten or more persons, or three or more vehicles or equestrians, under common control or direction, maintain exclusive, non-public use of the public park, public grounds or public right-of-way or a portion thereof. This definition shall not include any city-sponsored activities or those engaged in by governmental officers or employees acting in their capacity as such, or persons under their direction; any military organization; any funeral procession; any group activity regulated under the provisions of Section 539.16; or any person while engaging in his or her lawful employment in business or trade provided all other provision of the code are maintained.
(c) No person, corporation, firm or any other group of people acting individually or jointly shall sponsor or hold a public social function or special event without first obtaining a permit from the Director of Public Safety and paying the fee therefor. No person, corporation, firm or any other group of people operating under an issued permit shall fail to follow the conditions of the permit.
(d) All public social function and special event permits must be applied for and issued not less than sixty days before the date of the event to be held. The application period may be shortened by the Director of Public Safety or his or her designee for good cause shown.
