(A) Adoption of Standards of Safety.
(1) The Kentucky Standards of Safety (Fire Prevention Code) as promulgated in 815 KAR 10:060 by the Commissioner of the Department of Housing, Buildings and Construction on the advice and recommendation of the state’s Fire Marshal, is hereby adopted in full as an ordinance of the city.
(2) Copies of the code book are available through the Department of Housing, Buildings and Construction, 1047 U.S. 127 South, Frankfort, Kentucky 40601.
(B) Enforcement officer. The Fire Chief and Assistant Fire Chief of the city shall be designated as the local enforcement agent/agency for the Standards of Safety as appointed by the Fiscal Court or city.
(C) Permits and fees. The requirements for permits and required fees shall be as provided for in the schedule, per § 150.03 of this chapter.
(D) Appeal process. All final decisions of the Fire Code Official of the city shall be appealable to a local appeals board pursuant to the procedures adopted by the City Council.

(A) The city hereby adopts by reference herein as if fully set forth herein the Schedule of Fees dated 7-1-2017, attached to the ordinance codified herein, as recommended by PDS for processing and issuance of zoning permits, building permits, electric permits, Board of Adjustment hearing fees and fines for violations of these life safety codes when a violation of them has been classified as a civil offense.
(B) (1) In order for said schedule of fees to continue to reflect the increasing inflationary costs of administration of the above programs, said fees shall, on an annual basis, be adjusted by PDS and reviewed by the City Treasurer to reflect any increase that would be necessary with the conventional application of the Consumer Price Index as promulgated by the commonwealth’s Office for Local Government to these fees.
(2) That based upon this calculation said fees shall be increased annually and this Schedule of Fees shall be so amended by operation of this provision.

(A) The city’s Building and Zoning Inspector shall be designated as the local enforcement agent/agency for said Kentucky Building Code.
(B) All building code inspections shall be performed by persons certified by the commonwealth’s Department of Housing, Buildings and Construction.
(C) All electrical inspections shall be performed by persons certified by the commonwealth’s Department of Housing, Buildings and Construction as an electrical inspector.

Any suit brought against the Building and Zoning Inspector or employee because of any act or omission performed by him or her in the enforcement of any provisions of this subchapter, shall be defended by the City Attorney until final termination of the proceedings.

(A) Any and all inspections of real property or structures or buildings thereon within the city for which the Building or Zoning Inspector is empowered, permitted or authorized to conduct shall be performed during the hours of 9:00 a.m. to 5:00 p.m. on Monday through Friday, unless an emergency exists or upon agreement with the Building Inspector.
(B) All persons with any interest in real estate or buildings or structures thereon within the city shall, upon reasonable notice, make the premises available for inspection during those times set forth in this section.

INTERNATIONAL PROPERTY MAINTENANCE CODE
(A) This subchapter shall be known and may be cited as the “Property Maintenance Code”, and it shall apply to every building, structure or appurtenance connected or attached to such building or structure within the city.
(B) In any case where a provision of this subchapter is found to be in conflict with any existing code, ordinance or regulation of the city, the provision which establishes the higher standard shall prevail, except for the provisions of the Kentucky Building Code.

(A) The Building and Zoning Administrator is authorized to conduct surveys and make inspections in any area of the community to determine compliance with this subchapter or other ordinance the Administrator is empowered to enforce, and shall investigate all complaints, alleging or charging that a violation of this subchapter exists or that a building or dwelling is unfit or unsafe for human habitation or other occupancy.
(B) The Building and Zoning Administrator is authorized, on identification and statement of purpose, to enter, inspect, survey and investigate between the hours of 8:00 a.m. and 5:00 p.m., or at any time if an emergency exists, or if requested by the owner or occupant, all buildings, dwellings, dwelling units, rooming units and general premises. The owner or occupant of every building, dwelling, dwelling unit, rooming unit and general premises or the person in charge thereof shall give the Building and Zoning Administrator free access to such building, dwelling, dwelling unit, rooming unit or general premises for the purpose of such inspection, survey or investigation.
(C) The Building and Zoning Administrator shall keep records of all complaints received, inspection reports, orders and complaints issued, and of other actions taken and those records shall be available for public inspection.
