The duties of the Shade Tree Commission shall be as follows:
(A) To study the problems and determine the needs of the city in regard to tree planting, maintenance, protection and removal;
(B) To recommend to the proper authority the type and kind of trees to be planted upon city streets or parts thereof or in parks or other public lands;
(C) To assist the properly constituted officials of the city, as well as Council and the residents of the city, in the dissemination of news and information regarding the selection, planting and maintenance of trees in the city, whether on private or public property, and to make such recommendations from time to time to Council as to desirable legislation concerning the tree program and activities for the municipality;
(D) To provide regular and special meetings at which the subject of trees, insofar as it relates to the municipality, may be discussed by members of the Commission, by officers and personnel of the city and its divisions and by others interested in the tree program;
(E) To provide technical advice and assistance to developers, builders, contractors and others in the selection and protection of naturally occurring trees during the development of wooded areas; and
(F) When requested by Council, the Mayor or the Director of Public Service, to consider, investigate, make findings, report and recommend upon any special matter or question coming within the scope of its work.

Within a reasonable time after the appointment of the Shade Tree Commission and the approval of the members thereof, upon the call of Council, the Commission shall meet and organize by the election of a Chairperson and the appointment of a Secretary. The Commission shall then provide for the adoption of rules and procedures and for the holding of regular and special meetings as the Commission deems advisable and necessary in order to perform the duties set forth in this chapter.

(A) Rules and Regulations; Enforcement. The Shade Tree Commission shall have the authority to promulgate the rules and regulations of the Arboricultural Specifications and Standards of Practice governing the planting, maintenance, removal, fertilization, pruning and bracing of trees on streets or other public sites in the city, and shall direct, regulate and control the planting, maintenance and removal of all trees growing now or hereafter in any public area of the city. The Commission shall cause this chapter and Chapter 1026 to be enforced.
(B) Jurisdiction. The Commission shall have the authority and jurisdiction to regulate the planting, maintenance and removal of trees on streets and other publicly-owned property to ensure safety or preserve the aesthetics of such public sites, in accordance with the permit system contained in Chapter 1026.
(C) Supervision. The Commission shall have the authority and duty to supervise or inspect all work done under a permit issued in accordance with Chapter 1026.
(D) Conditions of Permit. The Commission shall have the authority to affix reasonable conditions to the granting of a permit in accordance with Chapter 1026.
(E) Master Street Tree Plan.
(1) The Commission shall have the authority to formulate a Master Street Tree Plan. The Plan shall specify the species of tree to be planted on each of the streets or other public sites of the municipality. From and after the effective date of the Plan, or any amendment thereto, all planting shall conform thereto.
(2) The Commission shall consider all existing and future utility and environmental factors when recommending a specific species for each of the streets and other public sites of the city.
(3) The Commission shall have the authority to amend or add to the Plan at any time that circumstances make it advisable.
