(A) Building Permit Required. No wind energy facility, or addition of a wind turbine to an existing wind energy facility, shall be constructed or located within the city unless the Building Commissioner, pursuant to the requirements of § 1345.03
, has issued a building permit.
(B) Fees. Application for conditional use approval by the Planning Commission shall follow the fee schedule set forth in § 1449.02
(B) of the Code of Ordinances of the city:
(1) Building permit fee(s) established pursuant to § 1449.08; and
(2) Any physical modification to an existing conditionally permitted wind energy facility that materially alters the size, type and number of wind turbines or other equipment shall require conditional use approval by the Planning Commission pursuant to § 1345.03. Like-kind replacements as determined by the Building Commissioner shall not require review by the Planning Commission.
