1343.01 MAINTENANCE OF ROOFS, GUTTERS AND DOWNSPOUTS.
   All roofs of every dwelling structure shall be maintained weather tight and shall be equipped with gutters and downspouts connected to a public storm sewer, except as provided herein below in Section 1343.02.
   Notwithstanding the foregoing requirement to connect to a public storm sewer, downspouts may be disconnected and diverted from the storm sewer into an approved water retention or drainage system as provided in Section 1343.02 if the following requirements are met:
   (a)    Gutters/downspouts shall not be disconnected and no alternative storm water retention or drainage system shall be installed if the property is not suitable or conducive for an alternative system.
   (b)    The direct flow shall be far enough from the house so it cannot flow back toward the building foundation wall.
   (c)    The water draining across the property shall not create flooding and/or erosion problems, or create any nuisance condition on the property or any adjacent private or public property.
   (d)    Disconnection of any gutter/downspout requires a permit as set forth in Section 1311.15(k) and shall be reviewed and approved by the Building Inspector and Village Engineer.
