(a) "Rain barrel or rain water storage container" shall mean an above-ground prefabricated storage receptacle with an automatic overflow diversion system that collects and stores storm water runoff from a roof of a structural design that would have been otherwise routed into a storm drain. A rain barrel or rain water storage container must meet the following design, construction, and maintenance requirements:
(1) Only one rain barrel or rain water storage container not exceeding 80 gallons of capacity may be installed at each yard downspout.
(2) Rain barrel or rain water storage container installations require the review and approval of the Building Inspector, the Village Engineer and the Architectural Review Board. Plans submitted for review and approval shall include a site plan drawn to scale showing the structure in relation to the property lines and the location of the downspout(s) proposed to be used for the rain barrel(s) or container(s), along with details of the type and size of the rain barrel or storage container and the method of connecting the overflow back to the downspout.
(3) The color of the rain barrel or other rain water storage container shall substantially blend with the exterior color of the home and nearby surroundings so that it is as inconspicuous as possible. The rain barrel or container should be indistinguishable from the house and be consistent with the home's materials and be concealed with material consistent in material, coloration, and style of the exterior of the home.
(4) A landscaping plan is required to show that the structure will not be visible from the public right of way or cause a public or private nuisance. Rain barrels or rain water storage containers visible from the street shall be screened by plantings or fencing of sufficient height and area to obscure the view of the barrel or container.
(5) Location of rain barrels or rain water storage containers shall comply with all setback requirements.
(6) Rain barrels or rain water storage containers shall be covered at all times and shall not cause excessive erosion, water damage or create a nuisance on public or private property.
(b) All alternative storm water retention and/or drainage systems, including but not limited to, rain barrels, rain water storage containers, and rain gardens, require a permit as set forth in Section 1311.15(k) and approval of the Building Commissioner and Village Engineer.
