557.05 ISSUANCE OF COMPLAINT OR CITATION.
   (a)    If the owner, lessee, tenant, occupant, or other person or persons having care of or in control of the land or premises on which the nuisance exists does not completely abate the nuisance within the time limit prescribed in this Chapter, or if such owner or other person obstructs or prevents the village from taking action to abate the nuisance, the Village Administrator, or his designee, may issue a complaint or citation in the Miami County Municipal Court or in the Bradford Mayor's Court, if in existence.
   (b)    Upon issuance and service of such complaint or citation, the owner or such other person or persons having care of or being in control of the land or premises on which the nuisance exists shall appear in court to answer the complaint or citation filed by the Village Administrator.
   (c)    If the hearing officer determines that the owner or such other person or persons having care of or being in control of the land or premises on which the nuisance exists has not complied with the notice to abate the nuisance as set forth in the complaint or citation, said hearing officer may issue a penalty as set forth in Section 557.99 of this Chapter until such time as the nuisance is abated.
   (d)    Thereafter, if the same owner, or other person or persons having care of or in control of such land or premises fails to maintain such land or premises in accordance with this section, within the same calendar year, then the Village Administrator or his designee shall be permitted to abate the nuisance or to issue a subsequent complaint or citation to the offender, without the necessity of following the notice procedure set forth in Section 557.03 of this Chapter.
