557.03 NOTICE TO ABATE NUISANCE AFTER INSPECTION.
   (a)    Upon verified information that the noxious weeds are growing on lands in the  municipality in excess of seven (7) inches in height, the Village Administrator or his designee shall cause written notice to be served on the owner, lessee, tenant, occupant, or person or persons having care of or in control of such premises, or, if said person does not respond at the premises, the notice may be posted on the door of the premises, notifying such person that such growth is in violation of this Chapter and that the growth must be cut, destroyed and removed within two (2) days after service or posting of such notice.
   (b)    If the owner, lessee, tenant, occupant, or person or persons having care of or in control of such premises is a nonresident of the Municipality whose address is known, the notice shall be sent to such person's address by certified mail. If such address is not known, it is sufficient to post the notice in a conspicuous place on said premises or to publish such notice once in a newspaper of general circulation in the county.
   (c)    This section does not apply to land being used under a municipal building or  construction permit or license, during the applicable period of such permit or license, or under a conditional zoning permit or variance lawfully granted.
