The Mayor shall exercise all powers granted by ordinance or state law which are not inconsistent with the charter, and shall have the power to:
(A) Classify and assign according to classification. Classify and place on the salary schedule any new employee of the city, approve advancements to higher steps on the schedule and assign any employee of the city to any department or branch thereof requiring services appropriate to the classification of the employee so assigned.
(B) Prescribe rules. Prescribe those rules and regulations not inconsistent with the charter or this administrative code which he or she shall deem necessary or expedient for the conduct of administrative agencies subject to his or her authority, and he or she shall have the power to revoke, suspend, or amend any rule or regulation of the administrative agencies subject to his or her authority.
(C) Investigate. Investigate and examine or inquire into the affairs or operation of any department, division, board, or commission either by himself, herself or by any person designated for the purpose by him or her; and when so authorized by the Council, he or she shall have the power to employ consultants and professional counsel to aid in the investigations, examinations, or inquiries.
(D) Overrule officials. Set aside any action by a department head subject to removal by the Mayor alone.
(E) Delegate duties. Direct any department or division under his or her control to perform the work for any other department or division.
(F) Appoint administrative committees. Designate from the administrative service those committees and the officers thereof which he or she shall find necessary for the proper consideration of administrative problems. The committees shall meet at the request of the Mayor and shall make those recommendations on matters referred to them which they shall find necessary for the best interests of the city.
(G) Participation in Council. Take part in the discussion upon all matters under consideration by Council but have no vote therein. Introduce and propose ordinances and resolutions and, if the adoption of the same shall be moved by a member of Council, they shall be considered and acted upon as if introduced and proposed by a member of Council.
(H) Approval or veto. Approve or veto every ordinance and resolution of Council. The Mayor may approve or disapprove in the manner provided below the whole or any item appropriating money, and the item so disapproved shall be void unless repassed by Council in the manner herein prescribed. On all non-appropriation legislation, his or her approval or disapproval shall cover the entire ordinance or resolution.
(1) Approval. If the Mayor approves an ordinance or resolution, he or she shall sign and return it within ten days after its passage or adoption by Council.
(2) Disapproval. If the Mayor does not approve an ordinance or resolution, he or she shall return it to the Council within ten days after its passage or adoption together with a written statement of his or her objections, which statement shall be entered in its entirety on the journal of Council. Not later than 30 days after the date upon which the Mayor returned the same to Council with his or her objections, the Council may reconsider the legislation. Upon reconsideration, if the legislation is approved by at least two-thirds of the members of Council, it shall take effect at the time of the vote of the approval or at a later date specified in the ordinance or resolution.
(3) Inaction. If any ordinance or resolution shall not be returned by the Mayor within ten days after its passage or adoption by Council, it shall become effective in the same manner as if he or she had signed it on the last day of the ten-day period.
