It shall be unlawful for any person to post, paste, paint, print, mark, stencil or nail any handbill, poster, advertisement or notice of any kind upon any curbing, sidewalk, fire alarm box or fire hydrant within the City. It is not an offense under this section for a person to engage in expressive conduct on the public sidewalks using non-permanent, non-toxic chalk in a manner that does not obstruct or interfere with the use of the sidewalks. It shall be unlawful for any person in charge of any place or premises to permit any dust, dirt or refuse matter therefrom to be thrown, placed or swept upon any sidewalk or street; provided, that in case of accident or necessity while properly using the street, such person shall not be liable if he shall immediately clean up the dirt, refuse or litter caused thereby, and on his failure to do so the same may be done by the City at his cost and expense, together with the costs of the action to recover the same.
