§ 133.40 VIOLATION.
   (A)   (1)   It shall be a violation of this subchapter for any person under the age of 18 who is enrolled in a public, private or parochial school to absent himself or herself from attendance at such school without the permission of his or her legal guardian(s) or parent(s).
      (2)   Any person who shall so absent himself or herself shall be guilty of the offense of truancy and be subject to the penalties set out in § 133.43 of this chapter.
   (B)   Emergency or unforeseen absences due to illness or other reasonable cause beyond the control of the person so absenting himself or herself from school without the permission of his or her parent(s) or legal guardian(s) shall not constitute truancy if such permission is obtained from said parent(s) or legal guardian(s) and submitted in writing to the proper school authorities within 24 hours of such absence.
