(A) Should a food vendor fail to provide the certification required by § 115.182 of this chapter to the Health Inspector within five days of the end of any quarter, the Health Inspector shall issue a written notice to the food vendor that the premises where the food vendor is doing business shall be ordered closed and the business license suspended unless evidence of extermination, as required by this subchapter, is presented to the Health Inspector within five business days or until a proper extermination is conducted by a duly licensed or approved exterminator and certification of such extermination presented to the Health Inspector.
(B) Any food vendor may appeal the order of the Health Inspector to close the business to the office of the Building Commissioner who may affirm, reverse or modify the decision of the Health Inspector based upon the information presented.
