4-10-8: GROUNDS FOR DENIAL OF PERMIT:
The city shall not issue a permit if, upon review of the application, any of the below is found to exist. The city clerk shall notify the applicant within five (5) days, in writing, specifically stating all reasons for denial of the permit:
   A.   The application is not on the form provided or does not contain the required information;
   B.   The applicant has made a false or misleading statement of material fact in the application for a permit;
   C.   The building, structure, equipment or location of such special event does not comply with or fails to meet all of the health, fire, building, safety and welfare requirements of the city;
   D.   The special event or its location is such as to interfere with or unreasonably obstruct the free flow of vehicular traffic or other means of travel on any public street or with pedestrian traffic on the sidewalks, except where use of such is sought and granted as part of the application for the special event permit;
   E.   Proof of insurance, executed written agreement for compensation, hold harmless agreement, financial assurance, or prepayment of the sum described in section 4-10-7 of this chapter, has not been delivered to the city;
   F.   The conduct of the special event or any portion thereof will be contrary to law;
   G.   The conduct of the special event or any portion thereof will unreasonably interfere with the preservation of the public peace, health, safety, or welfare of the city;
   H.   An applicant has had a special event permit denied for good cause within one year prior to the application, and can show no material change in the circumstances since such denial;
   I.   The applicant refuses to agree to, abide by, or comply with any of the conditions and regulations attached to such permit; or such special event will interfere or conflict with another event for which a permit has already been issued; or will interfere or conflict with another scheduled event which takes precedence by virtue of section 4-10-9 of this chapter;
   J.   In the city's discretion, the city has insufficient police and fire personnel available for monitoring the special event. (2003 Code § 5-12-07)
