7-3-303: ISSUANCE OF PERMIT TO MULTIPLE-UNIT RESIDENTIAL OCCUPANT:
   A.   An overnight parking permit may be issued by the director of transportation to an occupant of a multiple-unit residential dwelling only if the applicant meets each of the following conditions:
      1.   There is no available parking space upon the premises which the applicant resides.
      2.   No former parking area on the premises has been converted to and is presently used for other purposes without approval of the city.
      3.   The vehicle for which the permit is requested is registered to the applicant, rented or leased by the applicant, or the owner of the vehicle has otherwise authorized the applicant to use the vehicle. The applicant shall hold a current and valid driver's license to operate a vehicle.
      4.   There is insufficient off street parking facilities in the area of applicant's residence.
      5.   The applicant has diligently attempted to obtain off street parking and there is no usable off street parking available.
   B.   The maximum number of permits which may be issued shall not exceed three (3) for any dwelling unit, except as provided in subsection C of this section.
   C.   The director of transportation has the authority to grant additional overnight parking permits upon application of qualified applicants and proof that more than three (3) vehicles are registered to the legal occupants. The total number of parking permits issued for any dwelling unit shall not exceed the number of legal occupants of the dwelling unit that hold a current and valid driver's license.
