7-3-120: TEMPORARY PARKING RESTRICTIONS AUTHORIZED:
   A.   For purposes of this section, the following words have the following meanings:
    NATURAL DISASTER: Any fire, flood, storm, earthquake or other similar public calamity resulting from natural causes.
   PEAK HOUR: The hours in which weekday traffic flow is the heaviest for the day as established by the resolution adopted by the city council restricting the stopping, parking and standing of vehicles during peak hours on certain streets in the city.
   B.   The transportation official is authorized to temporarily modify the existing peak hour stopping, parking and standing restriction on any street to any period of time and on any day, whenever the transportation official finds that traffic congestion on the street with the peak hour restriction is likely to result from the stopping, parking or standing of vehicles during the construction, alteration, repair or improvement of that street or any street within the vicinity, or as a result of a natural disaster and the modification is necessary in order to facilitate the proper movement of traffic. In all other circumstances, modifications to existing peak hour stopping, parking and standing restrictions may be established by resolution of the city council.
   C.   The transportation official shall place or cause to be placed signs on such street giving notice of the modified restriction during the existence of the condition set forth in subsection B of this section. Once the condition ceases to exist, the previous peak hour restriction shall continue to be in effect.
   D.   When signs authorized by the provisions of this section are in place giving notice thereof, no person shall stop, park or leave standing any vehicle during the time and day period posted on such signs.
   E.   The transportation official shall provide notice of the modification of the peak hour stopping, parking and standing restriction to the city council within thirty (30) days of taking action. If the modification remains in place for one hundred twenty (120) days, the transportation official shall provide a report to the city council on or before the one hundred twentieth day regarding the existence of the condition of the street with the modified peak hour restriction. This report shall be provided to the council for every subsequent one hundred twenty (120) day period until the transportation official or the city council determines that the condition set forth in subsection B of this section ceases to exist.
