Development projects for which all discretionary permits have been granted prior to September 19, 1989, shall be exempt from the requirements of this article. Such exemption shall continue to apply to an exempted development project which is subsequently modified provided that such modification does not increase the number of dwelling units in a multiple-family residential development project or increase the square footage of a commercial or industrial development project. This exemption, however, shall not override any condition of approval for a project which specifically requires payment of fees for the purposes of mitigating impacts on transportation facilities and programs.
