§ 132.036 MISREPRESENTATION OF AGE.
   No person under 21 years of age shall misrepresent his or her age in writing or by presenting false documentation of age for the purpose of inducing any person to sell or serve him or her alcoholic beverages. Any person who violates this section shall be guilty of a misdemeanor and shall be punished by a fine of no more than $50.

§ 132.037 CONSUMPTION OF ALCOHOLIC BEVERAGES.
   No person shall drink or otherwise consume any intoxicating liquor, intoxicating substance, or intoxicating compound of any kind, or inhale glue, paint or other intoxicating substance, and to disturb the peace of any person in any public place, or in or upon any passenger coach, streetcar, or in or upon any other vehicle commonly used for the transportation of passengers, or in or about any depot, platform, waiting station or room unless authorized by the Oklahoma Alcoholic Beverage Control Act. Any person who violates this section shall be guilty of a misdemeanor and shall be punished by a fine of not less than $10 nor more than $100, or by imprisonment for not less than five days nor more than 30 days, or by both such fine and imprisonment.

§ 132.038 PUBLIC INTOXICATION.
   (A)   No person shall be drunk or intoxicated and disturb the peace of any person in any public or private road, or in any passenger coach, streetcar or any public place or building, or at any public gathering. Any person who violates this section shall be guilty of a misdemeanor and shall be punished by a fine of not less than $10 nor more than $100, or by imprisonment for not less than five days nor more than 30 days, or by both such fine and imprisonment.
   (B)   An intoxicated person in a public place who appears to be in need of help, if the person consents to the offered help, may be assisted to his or her home, an alternative facility pursuant to the provisions of the Oklahoma Alcohol Drug Abuse Services Act, or to an approved treatment facility by a police officer.
   (C)   A person who appears to be intoxicated, and as a result of such intoxication is unconscious in a public place or reasonably appears to be in danger of harming himself or herself or others, may be taken into protective custody by a peace officer and immediately brought to an approved treatment facility for medical or nonmedical detoxification.

§ 132.039 SALE, DELIVERY OR FURNISHING ALCOHOLIC BEVERAGES TO ANY PERSON WHO IS INTOXICATED OR WHO HAS BEEN ADJUDGED INSANE OR MENTALLY DEFICIENT.
   No person shall knowingly sell, deliver or furnish alcoholic beverages to any person who is intoxicated or who has been adjudged insane or mentally deficient. Any person who violates this section shall be guilty of a misdemeanor and shall be punished by a fine of not more than $500, or by imprisonment for not more than 60 days, or by both such fine and imprisonment.

§ 132.040 POSSESSION/CONSUMPTION OF ALCOHOL BY A MINOR.
   No person under 21 years of age shall, in any public or private place possess, consume or have control over any alcoholic beverage. Any person who violates this section shall be guilty of a misdemeanor and shall be punished by a fine of no more than $50.
