(A) License required. No person shall sell Christmas trees, ornaments or other decorations on or in leased premises, under cover or in the open, without first obtaining a license therefor.
(B) Cash deposits. Any person who obtains a license shall, in addition to paying the license fee specified in § 801.13(U), post a cash deposit with the city to guarantee the performance of all conditions of the license. The amount of the deposit is $100, which may be retained by the city as and for its liquidated damages in the event of failure of compliance with the conditions.
(C) Removal of items from premises after season. A licensee under this section shall cause to be removed all unsold Christmas trees, ornaments and other decorations, and any related items, from the premises involved by the January 5 immediately following the Christmas season to which the license pertains. Failure to cause the removal shall permit the city to retain the deposit required in division (B) hereof as liquidated damages for failure to comply.
(D) Obstruction of public ways. No person shall display Christmas trees on any parkway, street, alley or sidewalk in a manner as to block the free passage thereof.
