No person shall engage in or conduct a garage, attic, basement or house sale from any residence, store, structure or lot in the city without first obtaining a license therefor from the City Hall front desk receptionist and/or Clerk’s Office.

No license required by § 823.01 shall be issued unless there is full compliance with the following terms and conditions.
(A) The applicant for the license shall be the owner of the premises where the sale is conducted, the agent of the owner or the executor or administrator of the owner’s estate. Non-owners must submit a written permission letter from the premises owner at the time of application.
(B) The sale shall involve only personal property items owned by the applicant or members of his or her household.
(C) Only two sales shall be conducted by the same applicant or from the same premises during a season. The season runs between May 1 through October 31.
(D) No items for sale shall be located, and no sales activities shall be conducted, in the front yard area of any premises or on any public sidewalk, parkway area or other public property.
(E) All signs advertising the sale shall be located in the front yard area of the premises, and no sign, handbill or other advertising matter shall be located or posted in or upon any public parkway, building or other public property, with the exception of two signs, one for each corner parkway of the block on which the sale is occurring. The parkway signs shall be displayed only during the hours of 7:00 a.m. and 7:00 p.m. and only on days of the sale.
(F) The sale shall be limited to a consecutive period of not more than two days and shall be conducted only between the hours of 9:00 a.m. and 5:00 p.m.
(G) The sale shall be conducted without the use of outdoor loudspeakers or other amplification equipment.
(H) The sale shall be conducted in accordance with all other laws or ordinances of the city.
(I) The license shall be valid only for the particular sale and premises designated in the license and shall be posted in the front yard area so as to be easily seen by the public. The license is nontransferable.
(J) No license shall be issued, and no person or premises shall be eligible for the license, to conduct a sale of personal property items more than twice during a season. Casual sales under this § 823.02 are rain or shine events. Permits will not be cancelled or re-issued for any reason including inclement weather.

There is no fee for the first license required by § 823.01. The second license issued within the season running between May 1 and October 31 shall be $20.
