(A) The director of parks and recreation shall be appointed by the mayor. The director shall report from time to time to the mayor and city council on the proper administration of the department of parks and recreation of the city.

(B) The director of parks and recreation shall operate and maintain all public parks, playgrounds and recreational activities in the city, and shall supervise all employees concerned with the maintenance and operation of such activities. The director shall consult with the parks, playground, recreation and leisure service board in the operation and maintenance of the municipal parks and recreation system, but shall be ultimately responsible to the mayor and city council, or their designated agents.

(A) Closing hours for the Berea City Park Expansion are hereby fixed at 11:00 p.m., each night during the months of April to October, and 9:00 p.m., during the months of November to March, and such parks shall remain closed from the hour indicated until 5:00 a.m., that following day.
(B) Lights shall be turned off at 11:00 p.m., on all athletic fields (soccer and football), skatepark, and basketball court unless granted permission in advance from the Parks and Recreation Department during the months of April to October. Lights shall be turned off at 9:00 p.m., on all athletic fields (soccer and football), skatepark, and basketball court unless granted permission in advance from the Parks and recreation Department during the months of November to March.
(C) During the hours the parks are closed, no person shall remain in or enter the premises except city maintenance employees, officials of the city, and law enforcement officers, who shall have the right to enter on the premises for purposes of patrolling, enforcing the law, or other appropriate administrative purposes.
(D) Civic or other non-profit special interest groups may request an extension of such hours from the Parks and Recreation Director. No extension shall exist until such time it is approved by the Parks and Recreation Director.
(E) During the hours such parks are closed, it shall be unlawful for any person, firm or corporation to park and leave standing any vehicle inside the park, Folk Center parking, or Intergenerational Center parking lots.
(F) Any person, firm, or corporation violating any provision of this § 22.004 shall be guilty of a violation and shall be subject to a fine not to exceed two hundred fifty ($250.00) dollars.

ARTICLE II. POLICE AND FIRE DEPARTMENTS
Division 1. General Provisions
In order to comply with the fair labor standards act of the federal government and the minimum wage laws of the state, the city council does hereby convert the basis of pay for employees of the police and fire departments of the city, from a monthly salary, to an hourly rate, with all such employees to be paid one and one-half (1½) times the rate or hourly rate for each hour worked in excess of forty (40) per week.

(A) All appointments of policemen or firemen, except chiefs and assistant chiefs, should be within the classifications set out in Chapter 23 and § 22.101, and the hourly rates shall be the amounts as specified for each classification.
(B) The mayor may, at his discretion, appoint all policemen and firemen from the same classification, or they may be appointed from any combination of classifications.
