ARTICLE I. RECOUPMENT OF FRANCHISE FEES
In the event that the city becomes the owner of any public utility subject to a franchise fee, on and after the date of such acquisition, in order to replace and recoup in a revenue neutral fashion any such amount of franchise fee paid or payable, each bill to customers for such public utility acquired by the city shall include a franchise replacement fee equal to 3% of the gross bill for the utility service provided, which amount shall be remitted to the city for such replacement.

ARTICLE II. MUNICIPAL UTILITIES DEPARTMENT
There is hereby created and established the Municipal Utilities Department. The functions of the Municipal Utilities Department shall include the following:
(A) Construct, inspect, operate and maintain the city's public utilities facilities, including electrical distribution facilities, water supply and distribution facilities, and sewage facilities and treatment plants, as well as landfill facilities.
(B) Perform such other duties as may be required by the City Council, Mayor, or City Administrator.

There is hereby created and established the office of Municipal Utilities Superintendent who shall be appointed by the Mayor and approved by the City Council and shall be under the direct supervision of the City Administrator. The Municipal Utilities Superintendent shall be responsible for all matters relating to construction, management, maintenance, and operation of the physical properties of the Municipal Utilities Department; shall be responsible for the direction and control of all functions of the Municipal Utilities Department or any of its divisions; and shall supervise the acquisition and use of goods and equipment, and subject to the authority of the office of Mayor, hire and assign personnel in such a manner as to achieve economy and efficiency in the operation of the Municipal Utilities Department.
