313.031 HOMESTEAD CREDIT.
   (a)   The Director of Finance shall cause the granting of a credit in accordance with this section against the quarterly billing charged pursuant to Section 313.03 for each household that uses the sewer system of the City and is determined to be eligible under paragraph (b) of this section. The credit shall be computed as follows:
      (1)   Ten percent (10%) of the current quarterly billing for residential usage.
      (2)   The minimum quarterly rate for households eligible for and receiving a credit under this section shall be at the minimum usage of 5,000 gallons multiplied by the homestead rate.
 
   (b)   A person must meet all of the following requirements to be eligible for the credit provided under this section:
      (1)   The person must be a head of household and occupies a household as his homestead and who is financially responsible for its other occupants, if any, or the spouse of such a person if both occupy the same household.
      (2)   The person must occupy and own the dwelling unit.
      (3)   The person must have attained age sixty-four (64) prior to the first day of January of the year of application for reduction in sewer charges or certified as permanently and totally disabled by a state or federal agency having the function of so classifying persons.
      (4)   The person and his spouse, if any, must meet the county’s homestead exemption income requirements.
   An original or certified copy of a notice received from the County Auditor or the Tax Commissioner showing eligibility of the person making application under this section for a credit on utilities bills under Amended Substitute House Bill 230 of the 112th General Assembly of the State of Ohio or as may be amended, or an original or certified copy of a notice received from the County Auditor or the Tax Commissioner showing eligibility of the person making application under this section for a Homestead Exemption as set forth in Amended Senate Bill No. 6 of the 112th General Assembly of the State of Ohio or as may be amended, shall constitute evidence that the applicant meets the foregoing requirements. Eligibility for the credit allowed in this section shall be determined by the Director of Finance or his/her designee.
   (c)   Application for a credit under this section shall be in accordance with rules and procedures established by the Director of Finance.
