918.01 DEFINITIONS.
   As used in this chapter the following definitions shall obtain:
   (a)   "Smoking" means the combustion of tobacco or tobacco products in any form, including cigarette tobacco, pipe tobacco, cigar tobacco and all other types and forms of tobacco products.
   (b)   "City property" means any enclosed area of any building, structure, vehicle or other enclosed space owned and operated by the City and wheresoever located within the Municipality. "City property" shall also include the area within the confines of the fence and surrounding the municipal pool.
   (c)   "Tobacco" means the viscid foliage of a plant of the nightshade family, genus nicotina, or other vegetable matter used in the manufacture of cigarettes, cigars or in the preparation for sale of pipe tobacco.

918.02 PROHIBITION AGAINST SMOKING; DESIGNATED SMOKING AREAS.
   Except as otherwise provided in Section 918.03, no person, including a member of the public or employee of the City, shall cause to occur the combustion of a tobacco product on any City property, as defined in Section 918.01(b). The Mayor or his designee may designate certain outdoor areas near such City property as designated smoking areas.

918.03 EXCEPTIONS.
   The following areas are specifically exempted from the application of Section 918.02 to wit:
   (a)   That portion of any vehicle completely open to the atmosphere, but not including the cab or driver area of the same, and without regard to presence or absence of windows;
   (b)   The cab or driver area of any vehicle when occupied by not more than one person, where such person causes the combustion of a tobacco product.
