1313.12 PREMISES CONDITIONS.
   (a)   Sanitary Requirements. All exterior property areas and premises shall be maintained in a clean, safe and sanitary condition free from any accumulation of rubbish or garbage. No owner or occupant of any premises shall maintain or permit to be maintained at or on the exterior property areas of such premises any condition which deteriorates or debases the appearance of the neighborhood, adversely alters the appearance and general character of the neighborhood, creates a fire, safety, or health hazard, or is a public nuisance, including, but not limited, to:
      (1)    Broken or dilapidated fences, walls, or other structures.
      (2)   Used or out of use appliances or automobile parts.
      (3)   Rugs, rags, or other materials hung on lines or in other places upon such premises, which materials are not being used for general household or housekeeping purposes.
      (4)   Broken, dilapidated or unusable furniture, mattresses, or other housekeeping furniture not designed for outdoor use, or paints, miscellaneous coverings and/or any other materials placed at or on the premises that contributes to neighborhood blight.
      (5)   Any condition which attracts rats, snakes, mosquitoes or vermin.

   (b)   Inoperable Vehicles.  
      (1)   No owner or occupant of any residential premises shall allow or be allowed to keep or store any inoperable vehicles on the premises for more than sixty (60) days, regardless of the condition or alleged value of said inoperable vehicle.
      (2)   Inoperable is defined as meaning a vehicle that is unable to be driven upon a public road or highway for any reason.

   (c)   Interior Conditions. The interior of every residential premises covered herein shall be maintained in a clean and sanitary condition free from any accumulation of rubbish, refuse or garbage. Rubbish, garbage and other refuse shall be properly kept inside temporary storage facilities as required in Section 1313.35. Garbage or refuse shall not be allowed to accumulate or be stored in public halls or stairways.
   (d)   Violations and Penalties.
      (1)   Any person violating this section shall be guilty of a minor misdemeanor and shall be subject to a fine of up to one hundred dollars ($100.00) per offense. Each day of violation may be considered to be a separate offense subject to a separate penalty.
      (2)   The Safety-Service Director may seek injunction relief to abate nuisances through the Court of Common Pleas of Washington County, Ohio.
      (3)   The Safety-Service Director may also abate nuisances after one warning by causing the nuisance to be removed and by seeking to recover the cost by direct suit against the violator. (Ord. 10(2002-03). Passed 5-28-02.)
