1313.35 SANITARY CONDITION.
   (a)   Cleanliness. The owner or occupant shall ensure a clean, safe, sanitary structure and premises with each new lease. Every occupant of a structure or part thereof shall keep that part of the structure or premises thereof which that occupant occupies, controls or uses in a clean and sanitary condition. Every owner, or his/her designee, of a dwelling containing two or more dwelling units shall maintain in a clean, safe, and sanitary condition the shared or public areas of the dwelling and premises thereof.
   (b)   Disposal of Solid Waste. Every occupant of a structure or part thereof shall dispose of all solid waste in a clean, safe, and sanitary manner by placing it in containers equipped with tight-fitting covers as required by this code. Containers shall be placed in the street or collection point to be picked up no more than 24 hours prior to scheduled pick up time. Containers shall be removed from the street no later 12 hours following the scheduled pick up.
   (c)   Solid Waste Storage Facilities. Every dwelling unit shall be supplied with an approved solid waste container as required in subsection (b) hereof. Such facilities shall be sufficient to meet the needs of the occupants.
   (d)   Citations for Failure to Properly Dispose of Solid Waste. The Service-Safety Director shall supply code enforcement officers, police officers and parking enforcement officers within citation tags for the purpose of giving notice to persons violating subsections (a) to (c). The notice may be given by delivering such tag to said violator. The citation tags shall direct the violator to properly store the rubbish and garbage, place containers for pick up and remove them after pick up. The penalty for violating subsections (a) to (c) shall be a fine of twenty dollars ($20.00) for the first offense, thirty dollars ($30.00) for the second offense and forty dollars ($40.00) for each additional offense.
   (e)   Kitchen. All spaces used or intended to be used for food preparation shall contain suitable space and equipment to store, prepare and serve foods in a sanitary manner. There shall be adequate facilities and services for the sanitary disposal of food and related solid waste, including facilities for temporary storage when necessary.
   (f)   Supplied Fixtures and Equipment. The owner or occupant of a structure or part thereof shall keep the supplied equipment and fixtures therein clean and sanitary, and shall be responsible for the exercise of reasonable care in their proper use and operation.
   (g)   Furnished by Occupant. The equipment and fixtures furnished by the occupant of a structure shall be properly installed and shall be maintained in good working condition, kept clean and sanitary and free of defects, leaks or obstruction.
