§ 153.07 UNSAFE CONDITIONS.
   (A)   The Code Enforcement Officer shall determine that a dwelling is unsafe and represents a threat to life and property if any one or more of the following conditions exist.
   (B)   Given the prevalence of second homes in the town, "winterizing" or otherwise maintaining a residence to be used only seasonally with intermittent absences is permitted relative to divisions (B)(1) through (4) below:
      (1)   No operating heating facilities between November 1 and March 30 of any year;
      (2)   No potable water service;
      (3)   No hot water supply;
      (4)   No electricity;
      (5)   Failing or failed primary structural members that threaten the stability of the dwelling and/or visible structural defects that appear to render the structural members ineffective;
      (6)   Improperly operating, insufficient, or no sanitary facilities;
      (7)   Overloaded electrical circuits or unsafe or exposed wiring;
      (8)   Presence of raw sewage or open sewer inside the dwelling;
      (9)   Presence of uncontained flammable, combustible or poisonous liquids, solids or gases or life or health threatening depletion of oxygen;
      (10)   Missing roof or part of roof missing;
      (11)   Chimney flues clogged, inoperable, or otherwise insufficient for the intended use;
      (12)   The dwelling is a physical threat due to immediate possibility of collapse;
      (13)   The primary means of exit or escape in the event of fire or other emergency is blocked, substantially impeded, or structurally unsafe;
      (14)   Occupancy of below-grade habitable space that does not meet the standards of this code; and
      (15)   Internal accumulation of garbage.
