(A) Any person violating any provisions of this chapter for which no specific penalty is prescribed shall be subject to Chapter 11, § 11.01 of this code.
(B) Any person who violates § 90.03 shall be subject to a civil penalty in the amount of $500 per violation to be recovered by the town.
(C) (1) Violation of any provision of §90.04 shall subject the offender to a civil penalty in the amount of $100, to be recovered by the town.
(2) Violators shall be issued written notice of violation which must be paid within 72 hours after receipt of the notice. If the violator does not pay the penalty within 72 hours, the town may recover such penalty, and all subsequently accruing penalties, in a civil action.
(3) Each act committed in violation of § 90.04 shall be considered a separate and distinct offense. Each day’s continuing violation shall be a separate and distinct offense.
(4) Notwithstanding the foregoing remedies, § 90.04 may be enforced by appropriate equitable remedies issuing from a court of competent jurisdiction.
(5) Violation of § 90.04 shall not be a misdemeanor.
(6) In the event it is necessary for the town to institute a civil action to collect a civil penalty for the violation of any provision of § 90.04, the offender shall pay all court costs and reasonable attorney fees incurred by the town.
