§ 91.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   (1)   (a)   Any person, partnership or corporation engaged in the construction of a sewage system or involved in the installation, operation and/or maintenance of any or all components of a sewage system, shall implement such activities consistent with the sewage management permit and §§ 91.01 through 91.24. Any such activity conducted in violation of §§ 91.01 through 91.24 or the sewage management permit is hereby declared a public nuisance.
         (b)   In the event of a violation, the Township Board of Supervisors may institute suits, in equity or at law, to restrain, prevent or abate a violation of §§ 91.01 through 91.24. Such proceedings may be initiated before any court of competent jurisdiction. The expense of such proceedings shall be recoverable from the violator in any manner as may now or hereafter be provided by law.
      (2)   (a)   Any person who shall violate any of the provisions of §§ 91.01 through 91.24, or who shall fail to comply with any written notice from the township which describes a condition of noncompliance, shall be guilty of a summary offense and, upon conviction thereof, shall be sentenced to a fine of not more than $1,000 plus all legal costs including attorney fees. A new and separate violation shall be deemed to be committed for each day such violation exists.
         (b)   In addition, the township may institute injunctive, mandamus or any other appropriate action in law or equity for the enforcement of §§ 91.01 through 91.24. Any court of competent jurisdiction shall have the right to issue restraining orders, temporary or permanent injunctions, writs of mandamus, fines or other appropriate forms of remedy or relief.
   (C)   Any person who shall violate any of the provisions of §§ 91.35 through 91.45, shall, upon conviction before the Magisterial District Judge or other court of competent jurisdiction and in accordance with the procedures set forth in the Pennsylvania Second Class Township Code, 53 P.S. §§ 65101 et seq., be sentenced to pay a fine of not more than $1,000 per day during which such violation shall continue, plus all court costs and reasonable attorney fees incurred by the Township in enforcing the violation. Each day a violation continues shall constitute a separate offense, and each provision violated shall constitute a separate offense.
