§ 32.040 NON-REVERTING CAPITAL FUND.
   (A)   Pursuant to the request of the City Park and Recreation Board, there is hereby created a special non- reverting capital fund for the purpose of creek bank beautification, well restoration, maintaining clubhouse heating and cooling systems, carpet replacing, sank shop renovation, addition blacktopping, supplementing the tree planting program, band shell restoration, irrigation system maintenance, and general golf course improvements at Otis Park golf course on a periodic basis.
      (1)   Monies collected at a rate to be determined from time to time by the Park and Recreation Board from the surcharge or usage charge per round of golf (9 or 18 holes) on green fees, and a surcharge or usage charge assigned to memberships at Otis Park shall be deposited from time to time (but not less than once each month) with the City Clerk-Treasurer who shall in turn deposit the same in the said special non-revering capital fund.
      (2)   Monies so deposited in the said non- reverting capital fund shall only be withdrawn and expended for the purposes herein set forth and only pursuant to a prior appropriation ordinance having been adopted pursuant to law by the Common Council.

   (B)   Pursuant to the request of the City Park and Recreation Board, there is hereby created a special non- reverting capital fund for the purpose of improving and creating additional golf cart paths at Otis Park golf course on a periodic basis.
      (1)   Monies collected at a rate to be determined from time to time by the Park and Recreation Board from the increase costs of golf car rentals at Otis Park shall be deposited from time to time (but not less than once each month) with the City Clerk-Treasurer who shall in turn deposit the same in the said special non-reverting capital fund.
      (2)   Monies so deposited in the said non- reverting capital fund shall only be withdrawn and expended for the purposes herein set forth and only pursuant to a prior appropriation ordinance having been adopted pursuant to law by the Common Council.

   (C)   Pursuant to the request of the City Park and Recreation Board, there is hereby created a special non- reverting capital fund for the purpose of maintenance problems, such as leaks in the pool, new pumps, maintenance of the chlorination system, maintenance of the water slide, insurance on the slide, and unexpected and unbudgeted costs of the John Lowery Municipal Pool on a periodic basis.
      (1)   Slide fees and membership surcharge fees collected at rates determined by the Park and Recreation Board for the use of the John Lowery Municipal Pool shall be deposited from time to time (but not less than once each month) with the City Clerk-Treasurer who shall in turn deposit the same in the said special non-reverting capital fund.
      (2)   Monies so deposited in the said non- reverting capital fund shall only be withdrawn and expended for the purposes herein set forth and only pursuant to a prior appropriation ordinance having been adopted pursuant to law by the Common Council.
   (D)   At the request of the City Park and Recreation Board, the special non-reverting fund shall allow monies collected from aquatic programs sponsored by the Park and Recreation Department and slide fees and membership surcharge fees at rates determined by the Park and Recreation Board for the use of the John Lowery Municipal Pool to be deposited from time to time (but not less than once each month) with the City Clerk-Treasurer who shall in turn deposit the same in the said special non-reverting fund.
   (E)   At the request of the City Park and Recreation Board, the special non-reverting fund shall allow monies so deposited into the said non-reverting fund be withdrawn and expended for sums owed to instructors of the aquatics programs sponsored by the Park and Recreation Department and for the purpose of paying maintenance expenses such as repairing leaks, purchasing new pumps, maintaining the chlorination system, maintaining the water slide, insuring the slide, and providing for other unexpected and unbudgeted costs at the John Lowery Municipal Pool on a periodic basis as herein set forth and only pursuant to a prior appropriation ordinance having been adopted pursuant to law by the Common Council.
