909.23 REMOVAL ON PRIVATE PROPERTY.
   (a)    The City Arborist shall have the authority and right to require the removal of any dead or diseased trees on private property within the City when such trees constitute a hazard to life or property. Such removal shall be made in accordance with Sections 557.03, 557.04 and 909.14 of the Codified Ordinances.
   (b)    All stumps of trees shall be removed below the surface of the ground so that the top of the stumps shall not project above the surface of the ground.
   (c)    As an alternative to the assessment proceedings set forth above, the City Arborist is authorized and directed to provide for the removal of any dead, diseased or dangerous tree on private property within the City without cost to the property owner when it is determined that such service would be conducive to the public health, safety and welfare of the residents of the City. The City Arborist shall arrange for the removal of such trees by use of City forces or by use of a tree removal service in those instances where City forces are unable to safely perform the work of tree removal.
