557.03 REMOVAL OF TREES, WEEDS, GRASSES BY CITY; CHARGES.

   (a)    In the event the owner does not trim or remove any tree, plant, shrubbery or part thereof in accordance with the provisions of this chapter, the City Arborist is hereby authorized, and it is hereby declared to be his duty, to provide for the enforcement of the provisions of this chapter and to cause to be trimmed or removed such tree, plant, shrubbery or part thereof and cut and remove all grass and weeds.

   (b)    An owner, occupant or person having the charge or management of any lot or parcel of land within the City may consent to or request that the City perform such services for the entire growing season of each year. Such person shall be charged for these services in accordance with the provisions of this chapter.

   (c)    The cost to the owner for the removal of trees, plants, shrubbery, grass or weeds as set forth in subsections (a) and (b) by the Municipality shall be at the rate of one hundred dollars ($100.00) per hour. The Service Department shall bill the minimum charge of two hours or two hundred dollars ($200.00) for any such work. In the event the City is required to employ outside services for such removal work, the charge shall be the actual cost plus fifteen percent (15%) for administrative charges.

   (d)    Whoever violates this section is guilty of a minor misdemeanor. A separate offense shall be deemed committed each day during or on which a violation occurs or continues and for each repeated violation.
