Nothing in this chapter shall apply to the following:
(A) A display of fireworks by an organization or group of organizations authorized in writing by the City Council;
(B) A peace officer in the discharge of his or her duty;
(C) A person in the lawful defense of his or her person or family;
(D) A discharge of a firearm by a color guard for a military funeral;
(E) A discharge of a firearm by a color guard, military, or police unit in connection with a parade permitted or authorized in writing by the City Council; and/or
(F) A discharge of firearms or explosives in connection with a show or assembly permitted or licensed by the city, specifically authorizing the activity at issue.

(A) Enforcement duties. The Police Department shall enforce the provisions of this chapter. The Police Department, in accordance with applicable laws, may inspect private premises other than private residences and shall make all reasonable effort to prevent violations of the provisions of this chapter.
(B) Civil remedies. Injunction, action for abatement, or other appropriate civil remedy may enforce the provisions of this chapter.
(C) Noise impact statements. The City Council may require any person applying for a change in zoning classification, permit, or license for any structure, operation, process, installation, or alteration, or project that may be considered a potential noise source to submit a noise impact statement or a form prescribed by the City Council. It shall evaluate each such statement and take its evaluation into account in considering the license or permit applied for, or the zoning change requested.

(A) The first violation of § 93.06 shall be a petty misdemeanor punishable by a fine not to exceed $25, or one hour of community service to be determined by the city which may include but not be limited to one hour of listening to music selected by the Chief of Police. A second violation within six months of the first violation shall be a petty misdemeanor punishable by a fine of $300. A third violation within six months of the second violation shall be a misdemeanor punishable by a fine of up to $1,000.
(B) The first violation of any other provisions of this chapter shall be a petty misdemeanor punishable by a fine not to exceed $50. A second violation within six months of the first violation shall be a petty misdemeanor punishable by a fine of $300. A third violation within six months of the second violation shall be a misdemeanor punishable by a fine of up to $1,000.
