4-2-2: INTERNATIONAL BUILDING CODE ADOPTED; EXCEPTIONS; ADDITIONS:
   (A)   Code Adopted: The International Code Council Building Code 2015 edition is hereby adopted by reference as the Building Code of the Village subject to such deletions and additions of sections as are hereinafter provided.
   (B)   Promulgation Of Rules: The President and Board of Trustees may adopt rules and regulations to implement the provisions of this chapter.
   (C)   Additions To The International Building Code:
      1.   Section 101. Insert the Village of Barrington Hills
      2.   In lieu of section 107.2.5 Site plan:
FOUNDATION PERMITS - The code official is authorized to issue a permit for the construction of foundations of a building or structure for all but One and Two Family Dwellings and Townhomes, before the entire plans and specifications for the whole building or structure have been themselves approved, provided that adequate information and detailed statements have been filed complying with all of the pertinent requirements of this code and the applicant provides the village with adequate assurances, including a guarantee complying with section 6-5-1 of title 6 of the village code, that the building will be completed or the foundation removed. The holder of such a permit for the foundation shall proceed with construction, but only at the holder's own risk with the building operation and without assurance that a permit for the entire structure will be granted.
      3.   Section 202 Add the following definition: New numbering
FIRE CODE OFFICIAL wherever references throughout this chapter or the adopted codes refer to the Fire code, this shall be held to the Director of Administration, Building and Zoning Official or such designee as determined by the Village President and the Board of Trustees for the Village of Barrington Hills.
      4.   Add section 427 Radio and television antennas:
         a.   Permits Not Required: A building permit is not required for the erection and/or maintenance on the roof of any building of: (i) antenna structures for private radio or television reception (other than satellite antennas, private, as defined in title 5 of the village code) which are not more than twelve feet (12') in height; or (ii) satellite antennas, private, as defined in title 5 of the village code, with an overall diameter of not more than five feet (5') and a total height of not more than twelve feet (12'). Such antenna shall be erected so as not to injure the roof covering and, when removed from the roof, the roof covering shall be repaired to maintain weather and water tightness. No antenna shall be erected nearer to any required yard or dedicated right- of-way than the total height of the particular antenna, nor shall any antenna be installed nearer to an electric power line than permitted by the standards in the National Electrical Code 1 .
         b.   Permits Required: A building permit shall be obtained from the Building Official for the installation and maintenance of any satellite antenna, private, and any other antenna exceeding twelve feet (12') in height. The application for a building permit shall be accompanied by detailed drawings of the structure, methods of anchorage, and provisions for wind loads and screening. All service connections from the antenna to the building shall be installed below grade in such a manner as not to conflict with any below-grade utility lines, water supply lines, or sanitary facilities. The size, screening and location on the lot of a satellite antenna, private, shall comply with the accessory use requirements of the Zoning Ordinance, Title 5 of the village code, and such compliance shall be made part of the conditions for the issuance of a building permit.
            (1)   Loads: Every ground-mounted satellite antenna shall be securely assembled, braced and anchored without using guy wires to resist a wind of not less than twenty five (25) pounds per square foot (psf) on the net surface area of both sides of the antenna component plus the wind on ice-covered sections when subject to freezing temperatures. In computing wind loads, due allowance shall be made for the effect of shape and contour of the antenna as provided in Chapter 16 of the International Building Code, as adopted by the Village.
            (2)   Dead Loads: Every ground-mounted antenna shall be anchored in a concrete platform of a sufficient size and design to accommodate the dead load plus ice load.
            (3)   Uplift: Adequate anchorage to the concrete platform shall be provided, without using guy wires, to resist two (2) times the calculated wind uplift.
         c.   Grounding: All antenna masts, cables and components thereof, whether erected on the roof or mounted on the ground, shall be permanently and effectively grounded using lightning arrestors or similar protective devices as recommended in the National Electric Code.
      5.   Delete Swimming Pool Section and insert the following
Add section E4203.8 of the International Residential Code and insert the following language:
            (1)   No current carrying electrical conductors shall cross private residential swimming pools, either overhead or underground or within fifteen feet (15') of said pools.
            (2)   All metal fences, enclosures or railings near or adjacent to private residential swimming pools which might become electrically alive as a result of contact with broken overhead conductors or from any other cause, shall be effectively grounded.
      6.   Revise Fire Alarm Systems transmitting alarms 907.6.6
Fire Protection Systems/Supervision (Section 907.6.6)
      1.   In lieu of section 907.6.6 Fire Protective Signaling Systems:
All required fire protective signaling systems shall transmit alarm and trouble signals to a central station or as determined by the Village of Barrington Hills.
New Section added below
      7.   Chapter 11 Insert the following: Any conflicts with Chapter 11 and the Illinois Accessibility Code will require the stricter of the two requirements being enforced.
      8.   Chapter 18 Delete all references to wood footings and foundations. Wood footings and foundations are not allowed.
      9.   Add 1901.7 Cold weather requirements is deleted in its entirety and substituting in lieu thereof the following:
Definitions and requirements: Cold weather defined by the American Concrete Institute (ACI) 306 as: a period of more than three consecutive days where all of the following occur:
The average daily temperature is less than forty (40) degrees Fahrenheit.
The air temperature is not greater than fifty (50) degrees Fahrenheit for more than one-half of any 24 hour period.
The average daily air temperature is the average of the highest and lowest temperatures occurring during the period from midnight to midnight.
When cold weather concrete is in effect; footings, trenches, foundations, and piers shall be poured only on frost-free soil. The architect and/or engineer of record shall provide to the building official a cold weather concrete outline meeting ACI 306 requirements for review. Concrete must be protected for not less than forty eight (48) hours with insulating blankets.
Flatwork: After the first frost, the Building Official shall determine whether flatwork can continue. No flatwork will be allowed outside of buildings or garages from November 15th to April 1st without the approval of the Building Official. Flatwork is allowed in a building or garage, as long as the inside temperature is maintained at not less than fifty (50) degrees Fahrenheit for not less than 48 hours.
The use of heaters that expel gases into the area above a concrete floor shall be vented to the outside to avoid carbonation, which may cause dusting to the concrete surface.
      10.   Chapter 29 Plumbing is amended to delete "International Plumbing Code" and replace in lieu thereof the "2014 State of Illinois Plumbing Code".
      11.   Chapter 35 Delete all references to the International Plumbing Code and insert the Illinois Plumbing Code
Adopt the following appendices: C, F, H105, H106,

   (D)   Temporary Swimming Pools:
      1.   In accordance with the powers set forth herein, the President and Board of Trustees, adopt the following rules to supplement and supersede BOCA relative to temporary swimming pools.
         a.   Defined: A temporary swimming pool is a non-permanent structure which is erected for the purpose of swimming or bathing for use for a period to commence May 15 and terminate September 15. Such pools are generally termed "seasonal" or "portable".
         b.   Regulations Applicable:
            (1)   Electric: All electric to the pool shall be protected by ground fault circuit interrupters, which shall be GFCI receptacle outlets or GFCI circuit breakers. All electric shall be in approved conduit. Receptacles not serving the swimming pool equipment shall be located a minimum of ten feet (10') from the swimming pool wall. All receptacles shall have a weatherproof enclosure whether or not the receptacle is being used. All swimming pool equipment shall be properly grounded. Underground wiring shall be a minimum of five feet (5') from the swimming pool walls. An extension cord is not an acceptable means to supply power to the swimming pool pump;
            (2)   Allowance: A temporary swimming pool shall not be allowed:
               A.   Within the first fifty (50') of any lot line; and
               B.   On any portion of a lot which would result in it being visible at street height from the street or from the ground level of any adjacent property owner's principal dwelling;
            (3)   Decking: There shall be no permanent decking constructed, used or allowed as part of the erection of the temporary swimming pool.
            (4)   Cover: No pool cover shall extend more than six feet (6') above the water level of the temporary swimming pool;
            (5)   Size: The maximum size of a temporary swimming pool shall be no more than one thousand (1,000) square feet;
            (6)   Permit Required:
               A.   Application: Prior to erection of a temporary pool each year, an application for erection of a temporary pool shall be made on a form made available through the Village.
               B.   Fee: One hundred dollars ($100.00) (plus $100.00 CO fee) which includes the required final inspection. Payable upon permit application. Each additional inspection required for Code compliance shall result in an additional fee of thirty five dollars ($35.00) per inspection.
               C.   Inspection: An inspection is required when work to install the pool is complete, and pool must pass inspection prior to use. Failure to schedule an inspection shall result in permit revocation for the season. An inspection to confirm removal of the structure may be required on September 15 of each year.
               D.    Submittal Requirements:
                  i.   Executed permit application;
                  ii.   Plat of survey (11 x 17 maximum size) showing all existing structures, including fences and gates, the location of the proposed pool and where the GFCI outlet is located.
                  iii.   Product and specification sheets for pool and equipment.
Permit applications will not be processed without complete information and permit fee.
         c.   Enforcement:
            (1)   It shall be unlawful for any person, firm or corporation, or any agent, employee or contractor of such, to allow the erection of a temporary swimming pool in violation of the provisions of this subsection.
            (2)   Whenever the Building and Zoning Enforcement Officer shall determine, in the course of his duties, that a violation of any provision of this subsection exists, the Building Officer shall issue to the owner of the property and, in the Building Officer's sole discretion, to any known agents of the property owner a written notice of violation, which notice may be in letter form containing the following information:
               A.    Description: Description of nature and location of violation;
               B.    Violation: Village Code provision being violated;
               C.    Penalty: Potential penalty for continued violation;
               D.    Request: A request for the activity constituting the violation to immediately cease and/or a request for immediate appropriate action to remedy the violation; and
               E.    Notification: Notification that a reinspection for compliance will occur on a specified date not less than seven (7) days after date of the notice.
               F.    Reinspection: Upon reinspection, if the Building and Zoning Enforcement Officer finds that the violation continues, the Building Officer shall notify the property owner and, in the Building Officer's sole discretion, any known agents of the property owner in writing that the matter is being referred to the Village Attorney and shall forward all relevant information to the Village Attorney.
               G.    Unlawful Continuance: Any person who shall continue the activity after having been served with a notice of violation shall be liable for a fine of not more than seven hundred fifty dollars ($750.00). Each day that the violation continues shall be deemed a separate offense. (Ord. 18-10, 8-27-2018; amd. Ord. 21-09, 5-24-2021)
