905.08 PLACEMENT OF GOODS AND MERCHANDISE UPON SIDEWALKS, STREETS AND ALLEYS.
   No person shall place upon the sidewalks, streets or alleys, any goods or merchandise for the purpose of exposing them for sale, or for the purpose of advertising or attracting the attention of the general public.
   Provided, however, that all property owners or their lessees shall have the right to place their goods and merchandise, which shall mean all things commonly sold in retail business establishments, immediately in front of their respective businesses after complying with the provisions of this section. Provided, however that in no case may a merchant's display occupy more than fifty percent (50%) in length of the total front footage of his respective business. Provided further, that no display shall operate to disrupt the free flow of pedestrian traffic; block designated sidewalks as designated by the Director of Public Works; or cause congestion of designated fire lanes as designated by the City's Fire Chief.
   All property owners or their lessees who desire to make displays of their goods and merchandise in front of their businesses shall first secure a permit from the Mayor and furnish evidence of insurance coverage by submitting a certificate of insurance naming the Municipality as an additional insured party with a minimum of one hundred thousand dollars ($100,000) property damage/three hundred thousand dollars ($300,000) bodily injury; however, the Municipality reserves the right to require greater insurance coverage depending upon the type of display offered. In no case may the Mayor issue a permit until such is approved by the Director of Public Works. There shall be no fee charged for permits to merchants displaying in front of their own business.
