(a) Unlawful Acts. It shall be unlawful for any person, firm or corporation to erect, construct, alter, extend, repair, remove, demolish, maintain, fail to maintain, provide, fail to provide, occupy, let to another to occupy or permit another person to occupy any premises, property, structure or equipment regulated by the Village of Barboursville Building Code, or cause same to be done, contrary to or in conflict with or in violation of any of the provisions of this code, or fail to obey a lawful order of the code official or to remove or deface a placard or notice posted under the provisions of this code.
(b) Penalty. Any person who shall violate a provision of the Village of Barboursville Building Code, or any provisions Chapter 17 of the Code of the Village of Barboursville, upon conviction thereof, shall be subject to a fine of not less than one hundred dollars ($100.00) nor more than one thousand dollars ($1,000.00) at the discretion of the court. Each day a violation continues after due notice has been served shall be deemed a separate offense.
(c) Injunction. In the case of any unlawful acts, the mayor or such person as the mayor may designate is hereby authorized and empowered to institute and maintain a suit to restrain by injunction the violation of the building code, notwithstanding the penalty for the violation thereof.
(d) Special Fees. The payment of the fee for construction, alteration, removal or demolition for all work done in connection with or concurrently with the work contemplated by a building permit shall not relieve the applicant or holder of the permit from the payment of other fees that may be prescribed by law or ordinance for water taps, sewer connections, electrical permits, erection of signs and display structures, marquees or other appurtenant structures, or fees for inspection, certifications of the use and occupancy or other building privileges or requirements, both within and without the jurisdiction of the Department of Building Inspection.
(e) Fee Schedule. There will be a fee for each plan examination, building permit and inspection.
(f) Enforcement: The primary responsibility for the administration and enforcement of the city building code is vested in the building code official, with the cooperation of the chief of police, and all other city officers, each within the scope of his official duties.
(g) Stop Work Order. Unlawful Continuance. Any person who shall continue any work in or about the structure after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe conditions, shall be liable to a fine of not less than five hundred dollars ($500.00) or more than five thousand dollars ($5,000).
(h) New Buildings. A building or structure hereafter erected shall not be used or occupied in whole or in part until the certificate of use and occupancy shall have been issued by the Building Official. (Ord. 2022-06. Passed 7-19-22.)
