1705.04 CONFLICT.
   (a)   Whenever there arises a conflict between the State Fire Code and the State Building Code, the State Fire Code shall take precedence.
   (b)   Whenever there arises a conflict between the International Plumbing Code portion of the State Building Code and the rules of the West Virginia Department of Health and Human Resources, the rules of WV DHHR take precedence.
   (c)   Wherever there arises a conflict between the State Building Code and the statutory laws of the State of West Virginia, the West Virginia Code shall take precedence.
   (d)   If any provision of the State building code, including any provision of the Village of Barboursville's building department administrative manual, conflicts with any provision of the municipality's Charter, other municipal ordinances or with any provision of state law or any rule or regulation lawfully promulgated and in effect pursuant to authority of state law, the more stringent provision shall prevail if it is not inconsistent with the laws of West Virginia and is not contrary to recognized standards and good engineering practices. In any question, the decision of the state fire commission determines the relative priority of any such municipal ordinance or regulation and determines compliance with state building code by officials of the city.
   (e)   If any provision of the building department administrative manual conflicts with any ICC provision, the latter shall prevail.
   (f)   The following structures are not subject to inspection by the Village of Barboursville:
      (1)   Group U utility structures and storage sheds comprising an area not more than 200 sq.ft. which have no plumbing or electrical connections and are used only for residential storage purposes. (Examples include sheds that are for the residential storage of lawnmowers, tools, bicycles or furniture.) Not included are those utility structures and storage sheds which have plumbing or electrical connections are a non-residential use or for the storage of explosives or other hazardous or explosive materials.
